Agreement and adult responsibility
These terms are an agreement between you and Nearlight Creative Services (“Nearlight”, “we”), the provider of Curious Colour (“app”), not Apple. An adult with legal capacity must accept them and manage use by children in their care. An educator must have the authority and permissions required for students’ use. You are responsible for your own use and, to the extent permitted by law, the use you authorise or supervise. Nothing here makes a child personally responsible for an adult contract or waives rights that cannot lawfully be waived.
Licence and payment
The app is licensed, not sold. We grant a limited, non-transferable licence to use it on Apple-branded devices you own or control, in accordance with the App Store Usage Rules, including permitted Family Sharing or volume purchasing. One App Store purchase includes the app’s available local features; there is no subscription or in-app purchase. Prices, refunds and purchase administration are handled by Apple and applicable law. Do not redistribute the app, remove ownership notices, or reverse-engineer it except where law or an included open-source licence permits. We retain our rights in the app and included original materials; component licences retain their own terms.
Your photos, artwork and copyright
You must own or have all rights, consents or other lawful authority needed to import, photograph, convert, modify, save, print, share or otherwise use each image and resulting output. This includes copyright, trademarks, privacy and image or likeness rights, and any required parent or guardian consent. Having a photo, buying an object, using it privately, or using it in a classroom does not by itself grant all those rights. Conversion does not remove third-party rights or grant a licence to protected characters, artwork or brands. Do not use the app to infringe rights, harass, exploit children or create unlawful material. You choose the inputs and all uses of outputs and are responsible for checking permissions and legality before use. Nearlight does not approve, publish or clear your content and does not authorise infringement. We claim no ownership of your original content; any rights you have in outputs remain subject to existing third-party rights and applicable law. We do not promise outputs are unique, copyrightable or free of third-party claims.
Output checks and craft safety
Automatic conversion can omit, alter or invent details. Inspect the subject, numbers, colours, print orientation and bead pattern before use. Output is for creative activities, not factual, professional or safety guidance. Device capability, conversion time and printer results vary. Keep separate copies of artwork you want to retain. An adult must supervise cameras, scissors, small beads, adhesives and other craft materials. Small pieces are a choking hazard; keep them away from children under three and anyone likely to mouth them. Heating or ironing is for adults only. Follow the craft product’s age limits and manufacturer instructions; check printed bead calibration against your board. The app does not supply or certify physical craft materials.
Warranty limits
TO THE EXTENT PERMITTED BY LAW, the app and outputs are provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement, or a promise of uninterrupted, error-free operation or data preservation. This does not exclude any mandatory warranty, remedy or consumer right. Nearlight is responsible for applicable maintenance and support; Apple has no obligation to provide them. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no further warranty obligation; other applicable warranty claims are Nearlight’s responsibility.
Liability limits — important
TO THE EXTENT PERMITTED BY LAW, Nearlight and its personnel and licensors are not liable for indirect, incidental, consequential, special or punitive losses, lost profits, lost data or business interruption arising from the app or outputs, under any legal theory, even if advised of the possibility. To that same extent, our aggregate liability arising from the app is limited to the amount you paid for it. These exclusions and the cap do not apply to fraud, wilful misconduct, or any liability, personal injury claim, mandatory consumer remedy or other right that cannot lawfully be excluded or limited. They do not transfer our non-excludable legal duties to you.
Responsibility for third-party claims
To the extent permitted by law, you agree to indemnify and hold harmless Nearlight and its personnel against third-party claims, damages and reasonable legal costs caused by your unlawful content use, infringement of another person’s rights, or breach of these terms, including uses you authorise or supervise where the law permits assigning you that responsibility. This does not cover loss caused by Nearlight’s own breach, negligence or wrongdoing, or impose an obligation prohibited by consumer law. We will promptly notify you of a covered claim, allow you to participate in its defence, and reasonably cooperate at your expense. No settlement may require an admission or non-monetary obligation by us without our consent. This clause concerns lawful allocation between you and Nearlight; it does not prevent a rights holder from bringing a claim.
Apple and other services
Nearlight, not Apple, handles app-related product liability, regulatory, privacy and consumer claims and, as between Nearlight and Apple, investigation, defence, settlement and discharge of third-party intellectual property claims relating to the app or its possession or use. Applicable law still governs liability. Apple and its subsidiaries are third-party beneficiaries and may enforce these terms. Comply with applicable third-party terms for services you choose, such as iCloud, Photos, Files, printing and sharing. You represent that you are not in a country subject to a US government embargo or designated as supporting terrorism, and are not on a US prohibited or restricted-party list. Use and export must comply with applicable laws.
Ending use, changes and disputes
You may stop using and delete the app at any time. Material breach ends the licence to the extent permitted by law; surviving payment, ownership, lawful claim and liability provisions remain. Changes apply prospectively and material terms changes require renewed adult acceptance. A policy change alone does not authorise new data collection. Alberta law and applicable Canadian federal law govern, subject to mandatory law and consumer rights where you live. Edmonton courts have non-exclusive jurisdiction where lawful; you retain any mandatory right to your local courts. There is no forced arbitration, class-action waiver or restriction on truthful reviews. If a clause is unenforceable, the rest continues to the extent lawful. These terms and applicable App Store rules govern app use; a conflict with mandatory law or those rules is resolved in their favour.

Grown-ups supervise physical crafts. Small beads and pieces can choke: keep them away from children under three and anyone who mouths objects. Heating and ironing are for adults. Follow the materials manufacturer’s age limits and instructions; supervise scissors, adhesives, cameras and printers. Check bead calibration and card orientation before printing. Automatic illustrations may change details; check the finished result before use.
Use pictures lawfully
Only use photos and artwork you own or are authorised to use. Converting an image does not remove its copyright or privacy rights. A grown-up checks permissions before printing or sharing.
